Pursuant to articles 14, 15 and 16 of the Federal Law on Protection of Personal Data Held by the Individuals (hereinafter the "Law") and other applicable provisions, we hereby inform you that Operadora Xuna, S.A. de C.V., with commercial name Interactive Aquarium Cancun (hereinafter and indistinctly "Operadora Xuna", " Interactive Aquarium Cancun " or the "Responsible") with registered office at Avenida Nader Lote 28, Manzana 1, Supermanzana 2, Cancún, Benito Juárez, Quintana Roo, México C.P. 77500, is responsible for processing your personal data, as well as for its protection and use.

At Interactive Aquarium Cancun, one of our priorities is to respect the privacy of its users and to keep the information and personal data we collect secure.

This Privacy Notice always contemplates the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility in the processing of personal data.

 

 

PERSONAL DATA.

For the development of the purposes described in this Privacy Notice, we need to obtain the following personal data:

 

Identification data: first name, last name gender, tax ID (RFC) and/or CURP (for billing purposes, when applicable).

Demographic data: Gender and age.

Contact information: phone number, email address and residential address.

Payment information: credit or debit card details and signature (as reflected on bank vouchers, when applicable).

 

SENSITIVE PERSONAL DATA.

Pursuant to article 8 of the Law, in the case of sensitive personal data, Interactive Aquarium Cancun will be obliged to obtain the express written consent of the owner, through his autograph signature, electronic signature or any authentication mechanism established for such purpose. Interactive Aquarium Cancun does not request sensitive personal data.

 

USE OF INFORMATION.

The personal information collected will only be used for the following purposes: to provide and/or contract the services and products related to the friendly interaction between humans and dolphins, marine species and freshwater species that you have requested when booking with us though our websites, our call center or the ticket booths located within Plaza La Isla Cancun Shopping Mall.

This information will be used to notify you in the future about new services or products that are related to those already contracted or acquired; to inform you about changes in the same; to elaborate studies and programs that are necessary to determine consumption habits; to carry out periodic evaluations of our products and services in order to improve their quality; to evaluate the quality of the service we provide, and in general, to comply with the obligations we have contracted with you.

It is important to note that Interactive Aquarium Cancún does not sell or exchange customer information to any other public or private entity. We consider that the information obtained from you is only in our interest and to offer you our products   and   services   with   the   best   possible   quality.

 

DATA TRANSFERS TO THIRD PARTIES.

Interactive Aquarium Cancun only sends information to webhosting companies with whom it maintains current legal relationship in order to maintain, update and manage its web sites, through which it informs its users about activities, promotions and events.

 

LIMITATION OF USE AND DISCLOSURE OF INFORMATION.

As part of our communication and marketing efforts we may send you notifications about promotions, offers and services via email, only Interactive Aquarium Cancun has access to the information collected. Your request must include the following information:

  1. The name of the data subject and their address or any other means for receiving notifications.
  2. A copy of the document proving the identity of the data subject, or, if applicable, the legal representation and identity of their representative.
  3. A clear and precise description of the personal data for which the ARCO rights are to be exercised, except in the case of the right of access.
  4. A description of the ARCO right to be exercised, or what the data subject is requesting, and
  5. Any other element or document that facilitates the location of the personal data.

Your request will be answered within a period not exceeding 20 working days. Interactive Aquarium Cancun reserves the right to modify or update this privacy notice at any time, according to the applicable legislation on personal data protection, internal policies, new requirements for the provision or offering of our services or products and market practices.

ACCEPTANCE OF TERMS.

This Confidentiality / Privacy statement is subject to the terms and conditions described above, which in itself constitutes a legal agreement between the user and Interactive Aquarium Cancun. If the user uses the services in any of the Delphinus sites, it means that he/she has read, understood and agreed to the above terms.

 

AUTHORITY.

If the user believes that their personal data protection rights have been violated, they may approach the competent authority, the Secretariat for Anti-Corruption and Good Governance, in order to assert any claims related to the processing of their personal data.
